Acceptable Use Policy

Alien Heat provides web hosting to a large number of clients. We have a responsibility to protect each client and provide the best services available. The following guidelines have been established to insure this intent is met.

Content: All services provided by Alien Heat may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secrets and other statutes. Alien Heat is not responsible for any claims resulting from the use of our service. This is also true for sites that promote any illegal activity or content that may be damaging to Alien Heat servers or any other server on the internet. Links to such materials are prohibited. This also includes, but not limited to Adult sites, pirated software, hacker programs/archives, MP3, and Warez sites.

Programs: We do not allow programs to run continually in the background. This is to minimize system resources used and operational maintenance needed. We do not allow any chat or topsite programs on our servers other than the ones we pre-install for our clients to use.

IRC: We currently DO NOT allow IRC or IRC bots to be operated on our servers.

|
Commercial Advertising- Email (SPAM): Spamming, or the sending of unsolicited email, from a Alien Heat server or using an email address that is maintained by Alien Heat is STRICTLY prohibited and will qualify your site for immediate deactivation with no refund. Alien Heat will be the sole arbiter as to what constitutes a violation of this provision. Additionally claims investigated by Alien Heat about spam from any of our users or users of theirs, will be fined and billed for such work. The fee for such an instance if you are found to be at fault is $.50 per email sent and up to a $500 fine per incident.

Server abuse: Any attempts to undermine or cause harm to any Alien Heat server or customer of Alien Heat is strictly prohibited. Alien Heat holds no responsibility for the use of our clients' accounts. Any abuse of resources, where actions are not taken to desist, calls for immediate de-activation of that account without any refund of payments made. Any site using what we deem to be using excessive cpu cycles or any resources that cause strain to other sites may also be offered new terms.

Bandwidth: All sites hosted by Alien Heat have the privilege of unthrottled bandwidth. This means your site is placed on our ultra fast servers and connected to multiple backbones which allow a user to surf your site at unrestricted speeds. If they surf your site using a 56k modem or a DS-3, your site will always reachable. Your are not penalized for the high bandwidth web surfer that creates high traffic spikes. If your sites monthly usage is above your monthly total allotment you will be asked to upgrade to the next package. We will work with clients to keep their sites alive and fast at all times.

Back-ups: Alien Heat performs daily backups on all of our servers to ensure critical files are never lost. Our server software does create daily backups for users sites that you may download on your own, we do not restore a file any user has accidentally deleted or modified. The back-up restoration is for emergency procedures only. Your are advised to backup all of your own files to your local drive. Alien Heat is not responsible for lost data, time, income or any other resource due to faulty backups or non-existant back-ups.

Billing: Payments are due on the 15th day of every month. Accounts 14 days past due will be de-activated. Accounts 30 days past due will be deleted from the server without a refund of any payments made thus far. If any terms or conditions are failed to be followed the account in question will be automatically deactivated. You are also requesting us to register your site for you when selecting "new domain" in the order form of our site. We will use register such services for you on your behalf and ensure the correct name servers are used saving you time and money.

Cancellation: All cancellations must be sent to Sales@AlienHeat.com. While there are no cancellation fees, you must cancel prior to your next billing cycle. Payments made up to your cancellation date are not refundable. This includes any added support or service fees your contracted us to provide. We reserve the right to remove any account without advanced notice for any reason at any time without prior notice.

Refusal of Service: We reserve the right to refuse, cancel, or suspend service at our sole discretion.

These terms may be modified at any time and without prior notice. All users previous and new are always subject to the newest terms posted here at all times.
